    Does it Matter Who Has the Contract any longer?


    Old Rizzi keeps stirring me up sending me these links. Yeah I do have better things to expend my energy, like get up in the morning.

    Ancient history so the question is, does it really matter who has the contract for repair?

    Reality? No it doesn't matter so what difference does it make for a repairer other than have all the liability for what they do, crammed down their throats. Has any attorney, ANY attorney or shop for that matter made a substantive move toward who has the contract for repair? The answer is no and I can tell you why. They can't win. But they can talk about it, a favorite pass time to avoid the guts of the matter. You know like, what really matters.

    Wait for it...... verse 5,284. It is the source for pricing stupid.

    In my opinion, the only contract that matters to me, is the work order, signed by the owner of the vehicle.

    If his insurance company refuses to pay the invoice, they will have to explain it to their customer.

    ( I do mention that to any appraiser that questions my work order)

    I have helped my client repairers develop repair Authorization/Contracts consistent with the laws of their state that govern their business.

    Repair Contracts do work, are enforceable, and, when properly constructed. A well-crafted Repair Contract can and will offer an immense amount of protection for both the repairer and their customer, and in some situations, the insurers.

    Most importantly, when and if an issue should arise, the Repair Auth/Contract, when enforced, will often times expose the insurer's ill-practices compelling the customer to side with the repairer and to take action to protect their interests.

    Every repairer should have a viable Authorization to Repair/Contract which is based upon sound reasoning and their state's mandates and restrictions.
